Bosnian genocide

I don't have the will to write. I am shocked by the decision of the ICJ. I am even more shocked by the reactions of Serbian politicians to that decision. I simply don't believe this ruling has done justice to all the innocent victims that died in Bosnia.

I dont understand whats to be shocked about. Truly, why do people look for this moment of vindication?

Courts are not set up to provide satisfaction for victims but to get to the truth of a matter.

I've read the verdict and am satisfied that the judges have it largely right.

History books will now record the ICC's verdict. If what they found were the facts then we should feel satisfied not shocked.

There are quite a few things to be shocked about. The Court says genocide happened but doesn't identify the guilty party.

It says Serbia failed to stop it. But, so did every other country in the world.

This is not a just decision.

The court's job wasn't to identify who commited the genocide, but to decide Serbia's role in it. Should a defendant in every murder trial be declared guilty for the satisfaction of the victims? I'm not a lawyer, but I don't think that's how it works.

To further the murder analogy, a policeman on the scene not preventing a crime isn't the same as a civilian not doing it. Especially if the civilian in question was thousands of kilometers away...

Wrong. I cant stress highly enough, read the summary of the judgement. It says that the Bosnian Serb leadership / commanders carried out Srebrenica genocide.

It also says Belgrade is culpable -which it clearly was and I've said that from the beginning. It provided military, moral and financial support to the Bosnian Serbs. That is different (more serious) from other state of the world which were complicit in some other way.

They also used Hague tribunal record to come to their decision.

Really if people arent happy with the decision I think they should re-examine their own views on the Yugoslav wars rather than talk about political decisions of the ICC.

I regularly review my views on the Balkans and have not been consistent from the beginning. Theres a lot to be said in changing your mind when you find you are wrong on something.

I didn't say that every defendant should be guilty. I just said that this ruling doesn't seem JUST to me.

And what do you do with the policeman if he actually helped the perpertrator?
